    This is OK; Arnie seems willing to let gay marriage be decided judicially, but not electorally. Subject to the whims of an emotional electorate, gay marriage can never a popular issue. This is where judicial activism (dread phrase!) at the state level is necessary (as in Massachusetts) and "States Rights" can be a GREAT concept.

    The news today out of California is going to be really bad for Obama in the campaign. The GOP is now going to paint him as the "fag-lover" just like they did to Bill Clinton. We are basically screwed because as history has shown, when Californians voted on gay marriage, a HUGE majority of them rejected gay marriage. And now with Obama choosing the "Breck Girl", we are going to see some of the nastiest politics ever.

    Remember, the key is that when this issue has gone to the actual voters themselves, as it did in California, they respond overwhelmingly with anti-gay bigotry. That is precisely what the Republicans are going to feed off of in their negative ads targetting Obama.

    Polls in California show a major change in public attitudes toward marriage equality. The last I checked, a bare majority of voters approve of equality in California.

    I doubt very much that this is going to impact Obama.

    he's been saying the same thing about gay rights and marriage all along. the GOP hasn't hit him on it, the voter turnouts tell me that the people see it as a 'non-issue'... they'll just look bad if they do it.

    not to mention, they're trying to distance themselves from bush's presidency... how far can you distance yourself if you run on his same platform?

    mccain is going to lose... he isn't even liked by HIS party.

    Yup Terry Dolan...thanks so much Calif supremes for your timing. Is there a way to NOT have us come up during election years? They will now use this to shit all over the Dem no matter what the Dem says. It's an election year...time to drag out man on man butt fucking to keep the sheeple in line. Thanks Calif Supremes. America is a junior high school locker room, in terms of maturity and intelligence. Americans vote the way junior high kids think. Just pass the popcorn as McBush gets in because of this.

    As one of the biggest cynics on the face of the planet, I am absolutely flabbergasted by the court's decision. I thought for sure they'd take the "separate but equal" cop out.

    Of course "equal protection" means just that, but the machinations that bigots and wingers go through to find loopholes has become the norm and the law has always taken a back seat. That's why they've taken to bible thumping. They can select the quotes they like and interpret them any way they see fit - unlike the law of the land. Then get all high and mighty about violating "God's law". That makes most people absolute cowards when it comes to doing the right thing in the face of such overwhelming demagoguery.

    Get ready for the howls from the mighty righties about "activist judges". As if enforcing existing law without bowing to popular prejudices and false claims is somehow "activist".

    There is a group of wingnuts waiting to see if their initiative will qualify---to limit marriage to a man and a woman.

    Has the CA Supreme Court just ruled that this initiative will be unconstitutional if it passes, or before it passes?

    My partner of 36 years and I will finally be able to get married in CA! We were civilly united in Vermont, but this will be better.

    I hear wedding bells and see a big reception in our future!

    The problem is that the group in question in not trying to pass an initiative, but an amendment to the CA constitution. The court can't declare it "unconstitutional" state-wise, because it will be part of the constitution itself.

    I believe you are correct, but doesn't an amendment require 2/3s for passage? If so, wingnuts are wasting their time.
    It's taken them two years to get enough paid-for-gathering of signatures, and if they qualify, I don't think they can win.
    Californians are changing.

    The California Log Cabin Republicans (a gay group) are going to try and place an injunction on the ruling. Remember this is only a preliminary judgement and Republican groups like LCR are going to do everything they can to shut it down (characterizing it as a "special right"). Arnie may say he doesn't care, but Bush and his friends in California are going to be pressuring him like crazy behind the scenes.

    Also, the California religions institutions (a humongous lobby) are going to file suit claiming it breaches their freedom to descriminate against unrepentant homosexuals. There are a myriad of legal options the Right-Wing is going to immediately use and the ruling will undoubtedly be struck down within 72 hours.

    Someone mentioned this in another post, but it seems any initiative against this is DOA:

    Check this out from today's rulling:
    "we conclude that, under this state's Constitution, the constitutionally based right to marry properly must be understood to encompass the core set of basic substantive legal rights and attributes traditionally associated with marriage that are so integral to an individual's liberty and personal autonomy that they may not be eliminated or abrogated by the Legislature or by the electorate through the statutory initiative process."

    Any lawyers out here who can confirm any anti-gay marriage intiative is DOA?
