    I doubt if we'll get to find out. It wasn't a full-fledged SCOTUS case but a per curium decision according to Marcy Wheeler at FDL. I've always thought that there was a sort of gentleman's agreement between the two parties that prior to an election, they would restrain from bringing the courts into politics, but we can see that the current Republican Party will do absolutely anything to steal the election.

    With the economy the way it is in Ohio, verging on double-digit unemployment, more deaths of Ohio Nat. Guard forces who may have been your classmates or neighbors, and all the crime perpetrated by the former GOP state govt there----
    YES, OHIO WILL TREND BLUE, if they get all their votes counted!

    Sorry, Joe: the court does not run the precincts or count the ballots. Republican poll workers do. The actual election is a rare, bottom up thing; and that is where the fraud will take place. Provisional ballots will be handed out to complainers and then tossed. Its a feel good that the supreme court voted this way, but it pisses off a lot of Ohio poll workers who hate the government anyway, especially one that could become very different from the kind they want. They make or break an election, not the secretary of state. The court said nothing about inoperable machines or not enough machines either. Are you serious, Joe?

    Sorry Cab, but that's not the point. What the Republicans are trying to do by talking about ACORN is setting up a storyline whereby Obama's victory won't be legitimate. They may even try to legally challenge his election. By undercutting the ACORN challenge we undercut the possibility of them overturning the election. This has nothing to do with voter fraud at the local level. Are you serious? :-)

    No poll workers should be allowed to 'make or break' elections. This is one of the reason why we need national standards for elections. 2 words that don't belong together: 'voting' and 'machine' There is no reason to not have paper ballots everywhere. I live in CA and our paper ballots have ends of an arrow next to the candidate. You fill in the rest of the arrow next to the person you want. Very simple.

    I agree only to the point that we are talking about the current crop of corporate built and programmed machines with no requirement for transparency. If we could get nationally accredited machines with non-proprietary/secret software available for public testing - say by NIST or ANSI - and with a paper trail... that's something altogether different.

    I find it sad that the "best" way to vote in the early 21st century remains a piece of paper.

    yea and poll workers are not all republicans! i am a democratic election judge in texas. from my standpoint, it will be very very difficult to committ the type of fraud needed to steal an election AT THE PRECINCT LEVEL. those of us down here in the trenches don't have access to committ that type of fraud, period.

    cab, there is literally an army of Democratic and Republican poll watchers being sent out all over the country for this election, along with non-partisan observers too. I doubt very much the election will be won or lost by stuffing the ballot box or dumping ballots in the trash.

    Also, the one thing we should have learned after 2000 is that if the election results are challenged or attempts are made to cheat, more than likely that will be done in the courtroom, not in the local voting station. The Dems are playing it smart and they literally have a phalanx of attorneys all over the country ready to intervene in cases like this, which will be more frequent as we approach election day. To illustrate my point, read this article about the huge numbers of volunteer attorneys being sent out to monitor the elections, and the days leading up to it

    The REASON for the dismissal was lack of standing. The court did not rule on the merits of the suit. From my reading of HAVA and related court decisions (albeit a rather quick reading) it appears that only the U. S. Attorney General can bring this suit and there likely isn't the time to do so. So the fundamental issue hasn't been decided. And it is, indeed, possible the AG might file this before the election and it would certainly be expedited. However, this is good news in any event.

    The next GOP talking point will be that results can't be fully trusted, as there aren't enough accurate voting machines, equipment, personnel and funding for the results to be taken legitimately.

    In which case, the Repubs have no one but themselves to blame for refusing to fix these problems when they called all the shots in DC.

    The GOP had no problems with underfunding and faulty equipment when they had a chance to remedy the issue, now that the party is looking at a very long exile in the political wilderness, they should be spared NO sympathy for being screwed by their own stupidity.

    The Republicans whine about being "victims" of their own self-inflicted fiascoes, which makes their off-key caterwauling even more enjoyable when their BS bites their asses.

    After the 2000 voting fiasco in Florida, the government PROMISED to eliminate issues with voting. Since then, we have seen nothing but increased agitation over alleged voter fraud and suppression. Obviously, Republicans don't want anyone but the rich to vote. . .and the shantytown bigots and basement dwellers who show up at Sarah Palin rallies.

    I didn't know him personally, but I heard about him & his appointment as Solicitor General through alumni... Good on him! I also used to work for govt. in appellate practice, so I KNOW he's up there pretty high! It's great that he can avenge so many disenfranchised voters in Ohio, within the law!
    I couldn't believe that kids at nearby Kenyon College, OH had to wait some 18 hours to vote for Kerry in 2004. Maybe the whole system is "rigged," as they comment upthread, but there's nothing wrong with maintaining your principles to uphold Democracy!
    Did you know that some of the Federal judges in Ohio are Wooster alums, too? Pretty good for a small college!

So let's see...you want politicians to take more of your money...you don't mind a dishonest friend of a terrorist heading up what used to be the greatest nation on the planet...and you think someone else should tell you where you can go, what you can say, and how much you can make. Yep...sounds like the original founders ideas to me! I just wish ONE liberal could tell me why they want MORE government at a time when our "leaders" (both right and left) have lower approval ratings than even Bush! I dare you to have enough guts to see the TRUTH in people and to choose leaders who are not hypocrits. Not my fault if you all wake up one day from your "left wing overdose" to a socialist nation where you have NOTHING anymore. Makes no sense to dismiss the fraud involved with Acorn just because you think it will help one party or another.     Us liberals are mocked and ridiculed as being no more than a "fringe" of the electorate, yet in spite of not controlling the Executive Branch, the Congress OR the mainstream media, are still, somehow, able to force our agenda on an unwilling country and judicial branch.

    True, that's not a logically consistent viewpoint, but then again, "logical consistency"-as shown by URidiots above-never was a GOP strong point.

    Just think, all those unchecked, imperial powers Bush Jr was so quick to claim, and allowed to by obsequious bipartisan quislings, will pass on to Obama as President.

    Powers which included warrantless spying on US citizens and their communications, torture as official US policy, and indefinite detention.

    Funny how those supporting Bush Jr's use of such powers now are worried when Obama will be using those same powers.

    But I doubt they'll be cheering then, more likely, they'll suddenly start spouting off about how there needs to be strong judicial and legislative oversight of the Executive branch.

    The best aspect of this election, and the 2006 campaigns, is that the Bush Jr lackeys have been shown, the hard way, that they do NOT represent the political, social or religious mainstream in our society, and it's driving those knuckle-draggers completely off the cliff.

    The neocons are about to take a very long political exile, and they're powerless to stop their rapid decline from wielding political power all out of logical proportion to their actual numbers.

    Like I said...wrong is wrong. If it's George Bush, Barack Obama, Cinton, Gingrich, or Mickey Mouse. At least I have the integrity to see it for what it is and not just dismiss it because it's "republican" or "democrat". Most of the posts here reflect bitter partisanship without integrity. The same people who are quick to say that the former elections were "stolen" are the ones who are now praising this decision and giving ACORN/Obama a pass. All I have asked you to think about is why you want more control over your life by ANYONE who is dishonest, conservative or liberal. Integrity is not a liberal or consrvative issue folks.

    We don't have the best of choices this time around but let's at least agree that BOTH side of the aisle are not the most trustworthy at this point in our history.

    So anyone care to answer the burning question of why you want any of these leaders to control more of your decisions, money, and future?

    BTW...it's only called "trolling" when you have no desire for honest discourse. You decide if a little "salt" flavors the conversation or festers the wound.

    The Help America Vote Act of 2002 requires that states compare information contained on voter registration apps to information in the states motor vehicles databases and the Social Security database in order to confirm that it is an accurate and valid registration (Sec. 241(b)3) - clearly states requirements for making information available to polling sites. The Ohio Sec. of State has been "performing" these confirmations (she claims) but in secret, and will not share the information with election boards locally or the public (Sec. 206). This is a clear attempt to withhold information, which would probably prove ACORN as a fraudulent organization and cut their funding + include some jail time. In court, withholding information is considered criminal.

    This is not some new law (since she claims that she didn't have time to prepare to validate these registrations), she had plenty of time to comply with the law - but she thinks that she is above the law and wants to protect her party and friends.

    You know (on a personal note), I have to now question who does she owe the favor to that she needs to be protecting possible criminal actions? Is it the Democrat Party, Obama or Satan himself?

    And I don't know what fantasy you live in - but Democrats do control Congress and thanks to them - our econmy is down - and now so are American fundamentals.

    That is sec 241(b)3, word for word, it CLEARLY states that the registered voters appear on lists at appropriate sites, and does not in any way require information on crosschecks like you tried to imply. You either cannot read or are trying to mislead people. The GOP was trying to raise FUD (fear, uncertainty, doubt) since they feared they were losing Ohio.

    SEC. 206. <<NOTE: 42 USC 15326.>> DISSEMINATION OF INFORMATION.

    In carrying out its duties, the Commission shall, on an ongoing
    basis, disseminate to the public (through the Internet, published
    reports, and such other methods as the Commission considers appropriate)
    in a manner that is consistent with the requirements of chapter 19 of
    title 44, United States Code, information on the activities carried out
    under this Act.
    your second reference, the commission determines what info is appropriate and how to share, the GOP does not like what they hear so they sue. The court upheld that they were not the appropriate people to bog down this process, as they should have.

    How is it that I am trying to mislead people?

    "accurate lists of registered voters" - which it isn't accurate, people have admitted to voter fraud on video and signed statements, not just registration fraud but actual early voting fraud.

    "statewide voter registration list linked to relevant agencies and ALL polling sites" - which it isn't being allowed by the Ohio Sec. of State to be linked to polling sites nor to the public for purpose of dissemination.

    So it doesn't have to be crosschecked? That isn't very accurate - although I did put in the wrong section reference. I do sometimes type too fast. :-) But yes - you are right. I put in the wrong number when trying to condense my post (I didn't want my post to be too long or no one reads them). So I apologize for my original post (I can type long stuff and try my best not to condense it).

    The section I am referring to reads:

    "may NOT be accepted or
    processed by a State unless the application
    includes--
    (I) in the case of an applicant who
    has been issued a current and valid
    driver's license, the applicant's
    driver's license number; or
    (II) in the case of any other
    applicant (other than an applicant to
    whom clause (ii) applies), the last 4
    digits of the applicant's social
    security number."

    --- i.e., compared against the states DMV or compared against SS database. I won't put the rest of it here but people can be read it for themselves (I’m not trying to swap anyone – just putting the truth) - I didn't make the law I just try to follow them and clarify them. Do we have driver's license #'s or SS #'s on registrations for Mickey Mouse, Superman, etc? You can even look at other voter fraud going on in Ohio (again, not registration fraud). Look at Palestra.Net (a college reporting journalism team) – not the GOP party but people say the GOP is behind this mess.

    This isn't about voter suppression or anything like that as some like to claim. All we (American's) want is fairness. If Obama wins fairly, so be it. If McCain wins fairly, so be it. However, American's are a fair bunch and a fair nation, thus the outrage by American voters. If they can prove these are valid registrations and (from early ones) valid votes, no problem. I don't care who wins - I do care if there is fraud and expect investigations of ANY allegations of such fraud.

    And if this was just the GOP talking about it, no problem, that isn't proof enough for me. I don't take the word of either the Republicans or Democrats. I check it out myself and I am a free independent thinker. However, these are people (citizens) admitting fraud - not Republicans or Democrats party, with video proof to go with it.

    Thus - I see no reason why there can't be an investigation and some openness into registrations - in the interest of protecting the fundamentals of American rights. Hell - Congress would call a special prosecutor for much less than this and waste a lot of our money doing it. What is wrong with an investigation, unless you have something to hide? Seems like the Ohio Sec. of State has something to hide.

    Democrats have controlled congress overwhelmingly longer than republicans over the past 50 years. Has education ever been fixed as promised? Has the Social Security probem been fixed? Has poverty been wiped out? These same "campaign promises" have been laid aside election after election. We still feed the beast with higher tax burdens, handouts that never work, and pork projects that pander to consituents for votes. Isn't it time to "teach people to fish" rather than "give them a fish"? Fifty years of throwing money at problems to only end up in the pockets of government officials is too much! Forget greed on Wall Street....greedy politicians are the REAL problem!

    Again...why does ANYONE want the same failed policies of the past 50 years to guide our nation? Liberals complain about the past 8 years but won't open their eyes and minds enough to see the last 50. Can any liberal tell me why they want more of the past 50 years?

    Please...I'm really curious to know why anyone out there wants failed policies and politicians to promise more control over our lives. Do any of you have a good explanation for handing over your personal rights and responsibilities to government?

    We need change...but it's not going to come without politicians who are ready to lay aside personal ambition and their own hunger for power. We ALL need to send representatives to Washington who care about principle over power...about personal responsibility over keeping a voting block in need...and about integrity over interests. The economic deficit pales in comparison to the TRUTH deficit!

    So please tell me what you value and why it makes you eager to have Obama represent you. (Bush hating is not an intelligent stategy or answer either)

    Even if it's not a crime before it's committed would you stand by and watch a person with a bomb strapped to their chest and not think it was a potential problem?

    No one here yet has been intellectually honest enough to admit that what's happening in Ohio and more than 10 other states is wrong no matter what party you support. If indeed you thought what happened in 2000 and 2004 was so wrong, you should be demanding a full and deep investigation in this case!

    I'll write this slow so you can understand this. This is not voter fraud, this is registration fraud. It is not voter fraud until Donald or Mickey attempt to vote. Or the same person attempts to vote more than once. Or a dead person attempts to vote.
    And this is fraud against ACORN because the workers they have hired are faking some registration cards so they can be paid more because they turn more registrations in.
    Now I say ACORN should revamp the way the pay their workers, such as not pay them until all cards are checked or some other way. However this is the kind of work that mostly attracts workers looking to be paid at the end of each work day or period. I don't know that they would attract very many workers if payment was delayed, so I don't have the answer to that problem. Most if not all States laws state that all organizations must turn in all registration cards that workers collect or fill out. This was in response to a Republican organization doing street registrations and then throwing away Democratic declared voters cards in the trash and then when Democratic Voters went to vote they had never been registrar ed.
    IN Nevada ACORN separated all the cards that they thought suspicious or fraudulent and turned them into the County Elections Clerk along with the name and information of the worker responsible for each card. This was being done for several months and in each county ACORN was working, this was the process for ALL registration card turned in.
    After sitting on this information for several months during which ACORN was not advised of the status of the cards or workers ACORN offices were then raided and computers and files were seized and taken from the offices of ACORN.

    So tell me why, when ACORN was the one who was reporting the violations and had provided all the information, was a high profile, attention grabbing, Law Enforcement action taken when ACORN was more than cooperating?

    No, Voter Fraud is when electronic machines can be hacked to easy and there is no way to correct or check this problem without the machines being examined and Election Board bosses hide or erased recounts or manipulated recounts so the whole county would not have to be recounted.

    Oh wait a minute, in what State were election workers tried and found guilty of arraigning the way recounts were done so a total recount would not be done because of suspicious vote totals. Just a minute it will come to me, some where close to Ohio I think...ummm Oh I remember IT WAS OHIO, when it was a Republican Secretary of State.
    And didn't Ohio vote tally's go into the same computer server system that the National Republican Party controlled and use for their reelection campaigns?
    And wasn't it Republican Election Board chiefs who sent too few machines to the poor and African American precincts and those voters were forced to wait sometimes up to and over 8 hours to vote, while the rich white Republican voters had enough machines in most of their precincts where the average TOTAL time to vote was 5 minutes? In several of those precincts there were cases where the Black precincts had more registered voters and less machines total then the white Republican with less voters in their precincts. In other words black precincts had a higher voter number per machine than the white precincts by several times over. And wasn't it a Republican Secretary of State who refused permission to reprogram those voting machines from the white precincts that were closed for the night and take them to the black precincts to shorten the wait time? Didn't that Same SoS refuse to take voter registration cards because they were the wrong weight of paper and even after a court order still state he would refuse to take those cards?

    Remember that there was a scandal because some U.S. Attorneys were fired because they were unable to find any cases to prosecute for voter fraud, because there were no cases to prosecute. They tried in Missouri in the few weeks before the 2004 election. First the Justice Department had an guidelines that they did not file these cases in less than 30 days before elections so it did not affect the election. Second the prosecutions were so rushed they filed on the wrong person and misspelled and make other errors in the filing.
    Todd Graves was fired during the 2006 elections because he refused to file cases against ACORN and the Missouri Sec of State Robin Carnahan for voter fraud. Graves was replaced by Bradley Scholzman. Scholzman filed those cases in Missouri. EACH and EVERY case was dismissed. Scholzman came under fire for violating Justice Department guidelines for filing those case just prior to elections and engaging in partisan politics.

    So tell me how many SUCCESSFUL prosecutions of Voter Fraud in the last eight years under a Republican controlled Department of Justice who has been under the direction of President Bush to find any case no matter how small and to use all publicity available to trumpet these cases.

    Tell me this minuscule number and tell me that tiny, tiny, tiny percentage compared to the total voter count in a national election. Yes each and every ACTUAL case of voter vote is important and should be prosecute to the fullest. But only Republican operatives or idiots believe this is a widespread problem. And most Republican operatives are smart enough to know that they are spreading rumor and fear in an attempt to have legal voters illegally challenged and their votes illegally thrown out.
    It is Republicans who have illegally caged voters many of them Active Duty Military Voters stationed in Iraq and have caused their votes to be thrown out and not be counted.

    So yes Republicans are Whining again, big shock and once again Republicans are lying again, bigger shock.

    So to unmuddy the waters for those who might be confused. Democrats are trying to register as many voters as possible. ACORN receives monies from many sources and grants to register voters. ACORN turns in all registration cards filled out no matter by Democratic or Republican. ACORN has in several cases separated out the cards which they think are bad but still has to turn those in according to several State Laws.

    Republicans are trying to cage or have voters registrations disallowed because there is a difference between the cards and information in other sources like their drivers license. Small differences such as one has the middle initial listed and the other source does not. One was signed by a Jr. or 2nd or 3rd and it was listed on the other source.

    So which party is trying to commit Voter Fraud?

    And no liberals have ever voted for dead people? (Memphis, TN) No liberals have ever slahed the tires of vans that were meant to transport "conservative" voters to the polls? And do you not recall that just recently some election boards were denying a large number Republican absentee ballots just because one small box was not checked correctly? Once more....it's on BOTH sides people! Is it impossible for you to recognize wrong when it's a liberal?

    Why are liberals not screaming foul now like they did when it was supposedly Republicans disenfranchising voters in Florida? My original point if you had read it was that "wrong is wrong" no matter WHO has done it!

    I'm just asking you to be consistent in your anger and defense of ALL situations where wrong is suspected. Wrong is always forgiven or swept under the carpet if it involves liberal politicians yet those same politicians turn around and jump on every miniscule inference of bad dealings from conservatives.

    Does anyone not remember Trent Lott being thrown under the bus and out of office essentially for making a so-called racist at a retirement party? The liberals were all over him for this. Yet, Barack Obama sits in a sanctuary of God for over 20 years listening to a racist pastor, claims he didn't know his spiritual advisor felt this way and you ALL excuse THIS????? How hypocritical is that???

    This "change" you all think you want will never happen until you take off the blinders and see wrong for what it is on ALL sides. Be sonsistent...be fair...and maybe we can all have the change that will truly benefit our nation. More government, decades of broken promises, and refusal to look in the mirror is NOT the answer.

    I'm still waiting for just ONE person to defend why government is the answer for all our problems. Is there anyone bold and smart enough to defend this liberal ideology?

    This is a very insightful observation. First, consider that the two primary sources for allegations of voter fraud have come from Ken Blackwell and Rep. Tim Feeney, both of whom have been directly implicated in election fraud during 2004 and 2000, respectively. Second, consider that McCain's campaign manager was head of lobbying for Fannie Mae, a connection with which McCain had tried to smear Obama.

    Now consider McCain's additional allegations of domestic terrorism. Makes you wonder, doesn't it?

    They're just ensuring that the rigged election goes on as planned. The Supremes did the same with Bush in 2000, and they're gonna do the same in 2008. When will people wake up and learn that both sides of the politican fence are ALL controlled by the same people? We're only allowed to pick CFR members to be the President, but we don't even have that luxury because the winner is selected months in advance. This is obviously no longer a Republic (which the USA was founded as), and now it even isn't a democracy (which is nothing but "mob rule"). This is a one-party dictatorship. Way to piss away your freedoms, scum sheeple.
