It turns on the meaning of "Fill material." Purely a technical question. I'm not a lawyer but I don't think chemical waste is "fill material". It's not the Court's fault. It's the legislators' fault.
Why isn't there a law against ANYTHING that kills all the fish in a 23-acre lake??? Or is that claim contested?

I am actually very happy about this, why? Well the same people that think this is a great idea dont understand logic very well, most rural alaska operates on what? Ground wells. The chemicals and heavy metals that are used in mining go into lake, then fish eat, the people eat fish, the water goes deep into what? The water table. Now for all the alaska smart ones the water table isnt the thing you put next to the water bed, it is where your water comes from, and there isnt a magical buffer from the lake shore to keep in isolated so it spreads, and spreads, then animals drink water, then idiots eat the animals, then three legged babies are born, and disease and thinning of the human herd. But hey maybe the jobs this creates will give you great health benefits to cover the cancer you get.

This ruling is really really bad. It allows the EPA to defer to the Army Corp in defining mine hazardous waste as a "fill" material if it is dumped into a closed basin lake. There are literally tens of thousands of closed basin lakes all over the U.S. that now can be considered places for mining companies to dump hazardous waste. It shows you how far right the court has become on environmental law rulings.

Gawd, why the frack does it have to be dumped INTO the lake?! Why is not "sequestered somewhere near the mine" not good enough? No, they have to dump the waste into the lake where they know it'll kill everything in it, turning said lake into a festering toxic cesspool?

Arsenic is the main chemical byproduct used in gold production. Not only will it quickly kill all the fish and every other life form but it will seep into the groundwater and every other lake, stream and river that are interconnected killing everything in it's path. Gold companies know this, governments usually do not.
